The Election Petitions Tribunal of the National and State Assembly in Enugu on Wednesday annulled the election of Bright Ngene of the Labor Party as a member of the House of Assembly representing Enugu South Urban District.
Sam Ngene, the Peoples Democratic Party (PDP) in the March 18 elections, had questioned the election of Mr. Ngene.
Ngene, a former one-term House legislator, had argued in his petition that the number of annulled votes was greater than the number of votes credited to the LP candidate.
He further argued that the election should have been declared inconclusive and a rerun held to determine the actual winner.
Delivering its ruling, a three-person panel headed by AM Abubakar ordered a rerun of the elections in the constituency within 90 days to determine the actual winner of the elections.
The court explained that the ruling was based on the number of votes credited to Mr Ngene, the election winner, being less than the number of disenfranchised voters in the constituency.
He argued that the Independent National Electoral Commission was wrong to declare Mr Ngene the winner of the election.
Furthermore, it ruled that the electoral commission should have declared the elections inconclusive and conducted a rerun in polling units where it could not hold elections.
The sacking of the LP lawmaker came about 24 hours after a federal lawmaker of the party, Sunday Umeha, representing Udi/Ezeagu federal constituency of Enugu State, was sacked by the electoral tribunal.
