In a sobering tale of justice delayed, a Kenyan man named Barasa from Kisii County served over twenty years in prison for innocently purchasing a second-hand phone. Driven by entrepreneurial ambition and seeking to procure stock for his business, Barasa encountered a group of individuals selling the fateful device. Unaware of its illicit origins, he made the ill-fated purchase. However, fate had a cruel twist in store.
Barasa’s life took a dramatic turn when the phone’s owner was reported murdered, and the stolen device was traced back to him. Despite his genuine and detailed account of how he acquired the phone, his pleas fell on deaf ears. The court proceedings that ensued from 2003 to 2004 culminated in a devastating verdict: Barasa was found guilty of murder and sentenced to death.
In a grim twist of events, Barasa’s despair deepened as his appeal which he filed before his transfer to Naivasha Maximum Prison in 2006 remained unanswered until 2008. Finally, a glimmer of hope emerged when President Mwai Kibaki extended clemency, commuting Barasa’s death sentence to life imprisonment. Yet, the path to freedom remained arduous, as he endured ten more years behind bars.
In 2018, Barasa’s unyielding spirit and the wheels of justice aligned in his favor. He successfully appealed his sentence, reducing it to 25 years with credit for the 22 years already served. However, his ordeal did not end there. The High Court judge granted him an immediate release, ending his prolonged incarceration abruptly.
Barasa’s harrowing experience serves as a poignant reminder of the potential consequences of purchasing second-hand electronics. As he cautions fellow Kenyans, “Buying second-hand electronics without proper verification can lead to dire consequences.
