The PDP presidential candidate, Atiku Abubakar, has taken his case to the Supreme Court in an attempt to nullify the judgement of the Presidential Election Petition Court (PEPC). The PEPC had upheld the declaration of Bola Ahmed Tinubu as the winner of the 2023 presidential election on September 6th.
Atiku’s notice of appeal, which is based on 35 grounds, claims that the tribunal made a grave error and miscarriage of justice in its findings and conclusion of the petition challenging Tinubu’s presidency. Atiku’s lead counsel, Chris Uche, SAN, filed the notice of appeal.
Atiku is asking the apex court to set aside the tribunal’s findings and conclusions because they did not accurately represent the grounds of his petition.
Atiku also argues that the tribunal failed to nullify the presidential election, which was held on February 25th, due to non-compliance with the Electoral Act, 2022. According to Atiku, the evidence presented to the tribunal showed that INEC conducted the election based on grave and gross misrepresentation, contrary to the principles of the Electoral Act 2022, based on the “doctrine of legitimate expectation.”
